Here are three ways you can help ensure your Prenuptial Agreement is enforceable:
1. Full Financial Disclosure - Both parties should have full knowledge of each other's financial circumstances. All information concerning finances should be exchanged.
2. Sufficient Time - Both parties should have sufficient time to review the agreement. This should be done well before the wedding ceremony. Receipt of the proposed Agreement should be confirmed in writing including the date it was received.
3. Independent Legal Counsel - Both parties should have their own attorney to explain the law and assist in the negotiation process. At minimum each party should be given the opportunity to seek an attorney. If either party chooses not to obtain an attorney then the Agreement should indicate that they were given the opportunity but chose not to have an attorney.
